  • Chaitown Community Private Limited (“Chaitown”, “us”, “Our”) is committed to the protection of personal information provided by the Users to Chaitown. Users agree that visiting/use of Chaitown’s website (“Website”) and mobile application (“Mobile App”), or the use of the products and services available thereon, implies consent to the collection, retention and use of Users personal information in accordance with the terms of this Privacy Policy (“Privacy Policy”).

  • Chaitown takes the privacy of Users seriously. Chaitown is committed to safeguarding the privacy of Users while providing its Products and Services (as defined in the Terms of Use) in a personalized and valuable manner.

  • No information provided by the User to Chaitown is rented or sold to any third party. When a User uses the Services, Users’ IP address and other personal information may automatically get stored. A high standard of security is maintained by Chaitown for Users. However, the transmission of information via the internet and web networks is not completely secure. While Chaitown does its best to protect Users’ information, particularly with respect to protection of Users’ personal data, Chaitown cannot ensure the security of Users’ data transmitted via the internet, web network or any other networks.

  • Access to the contents of Chaitown is conditional upon User’s approval of the Privacy Policy which should be read together with the terms of use of service (“Terms”). Users acknowledge that this Privacy Policy, together with our Terms, forms a legally binding agreement with Chaitown in relation to the use of Services (“Agreement”). All capitalized terms used but not defined herein shall have the meaning ascribed to such term in the Terms.

  • Chaitown reserves the right to contact the customer via any mechanisms, not limited to Email, SMS, or phone calls, to solicit feedback of customer's experience and to provide any additional services that customer would be eligible for, either as a customer or as a visitor.

  • Chaitown Community Private Limited (“Chaitown”, “us”, “Our”) is committed to the protection of personal information provided by the Users to Chaitown.   2. Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (“SPDI Rules”); and

  3. Regulation 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

1.4 Legal Disclaimer
  • We reserve the right to disclose Your personally identifiable information as required by law and when we believe that disclosure is necessary to protect Our rights and/or to comply with a judicial proceeding, court order or legal process served on Our Chaitown Platform.

  • We may be required to share the aforesaid information with government authorities and agencies for the purposes of verification of identity or for prevention, detection, investigation including cyber incidents, prosecution and punishment of offences.

  • You agree and consent for Chaitown to disclose Your Information, if so, required under the applicable law.

1.5 A Special Note About Children
  • We do not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register for the Products or Services, including Fitness Services, or otherwise visit fitness centres, gyms or other physical premises.

  • If you are under 18, please do not attempt to register for the Products or Services, including Fitness Services, or visit fitness centres, gyms or other physical premises, or send any information about yourself to us unless such registration is completed by a parent or legal guardian.

  • In case a person below the age of 18 avails Our Services, the term “User”, “You” or “Your” shall mean the parent or legal guardian, depending upon the legality and practicality of usage of such term(s) in this privacy policy. 

  • No one under age of 18 may provide any personal information to us.

  • In the event that we learn that we have collected personal information from a child under age 18 without parental or legal guardian consent, we will delete that information as quickly as possible.

  • If you believe that we might have any information from or about a child under 18 without the verification of parent or legal guardian, please contact us at hello@chaitown.in or our Grievance Officer.

1.6 Change of Business Ownership and Control
  • Chaitown may, from time to time, expand or reduce Our business and this may involve the sale and/or the transfer of control of all or part of Chaitown. Information provided will, where it is relevant to any part of Our business so transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use the Information for the purposes for which it was originally given to Us.

  • We may also disclose Information to a prospective purchaser of Our business or any part of it.

  • In the above instances, we will take steps with the aim of ensuring Your privacy is protected

2.1 Information COLLECTED
2.1.1 Information you provide
  • In order for Users to access certain areas of the Website, Chaitown may require Users to provide Chaitown with certain information that personally identifies such Users ("Personal Information").

  • Chaitown may also collect certain data which are specified as sensitive and personal information under SPDI Rules such as passwords, medical records and history, physical, physiological and mental health condition etc. (“SPDI”). You hereby consent to collection of such information.

  • Personal Information inter alia includes the following categories of information:

  • Contact data required at the time of registration on the Website and the Mobile App, including your name, e-mail address, phone number, gender, location and any other contact details;

  • Demographic data (optional) such as time zone, postal address and location details;

  • Basic bank details for payment processing; and

  • Personal Information and SPDI (where necessary) collected for provision of the Services on the Website or Mobile App, including your passwords, and workouts related information, photographs.

  • If a User communicates with Chaitown by, for example, e-mail or letter, any information provided in such communication may be retained as Personal Information by Chaitown.

2.1.2 Information received from 3rd party Applications
  • To login or register an Account on Chaitown You may have to access third party service (such as Facebook, Google), the third-party service may send us information such as your registration, profile information etc. from that service.

  • This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.

2.1.3 Information we collect from you automatically

Chaitown automatically tracks and collects the following categories of information when Users access the Website, or use the Products or Services with the help of cookies:

  1. IP addresses

  2. Domain server details

  3. Types of devices accessing the Website and network carrier information;

  4. Referring source which may have sent Users to the Website; and/or

  5. Other information associated with the interaction of User’s device and the Website (collectively "Traffic Data”).

  • Nudity or other sexually suggestive content;

  • Hate speech;

  • Credible threats or direct attacks on an individual or group;

  • Content that contains self-harm or excessive violence;

  • Fake or impostor profiles; and

  • Spam.

2.2 USE of Information

We use your Personal Information and SPDI for the following purposes:​

  • The provision of Products and Services on the Website and the Mobile App including optimizing, or further developing/improving operation of the Platform or providing better user experience;

  • To contact you in relation to Products and Service offerings on the Website and Mobile App, including pursuant to current or future collaborations with third party service providers;

  • General business and operating purposes, such as the administration, management and operation of the business, including client/user interaction, responding to requests, customizing and improving our Services;

  • We may share the personal information you disclose to us on our Website within our company. We may limit access to such information to authorized individuals.

  • However, we may also disclose such information to affiliated and unaffiliated third parties who work with us on marketing, product development, service enhancement and other similar matters

  • Chaitown reserves the right to disclose Personal Information and SPDI if required to do so by law or if Chaitown believes that it is necessary to do so to protect and defend the rights, property or personal safety of Chaitown, its affiliates or group entities, the Products and Services, or other Users.

  • We may disclose to our affiliates or group entities and third party service providers certain personally identifiable information listed below:

    • Information you provide us such as name, email, mobile phone number.

    • Information we collect as you access and use our Service, including device information, location and network carrier.

  • This information is shared with our affiliates or group entities and third party service providers so that we can:

    • Personalize the app for you

    • Provide the Products and Services; and

    • Offer/provide any other services, offers, programs (such as loyalty programs), benefits, etc. by any of our group entities, affiliates or third parties, which will be complementary to our Products and Services or otherwise offer you a continuum of service offerings similar to the services or products offered on the Website or the Mobile App, subject to such terms as may be specified by Chaitown or its concerned affiliates/group entity from time to time.

2.3.3 Data RETENTION: How Long we keep your information
  • We store and retain the Personal Information and SPDI until we receive requests from the Users for deletion of the same.

2.3.4 PROTECTION of Data/Security
  • The security of Users’ Personal Information is important to Chaitown. Chaitown follows generally accepted industry standards to protect the Personal Information submitted to Chaitown, both during transmission and once Chaitown receives it.

  • Although Chaitown makes best possible efforts to store Personal Information and SPDI in a secure operating environment that is not open to the public, Users should understand that there is no such thing as complete security, and Chaitown does not guarantee that there will be no unintended disclosures of Personal Information and/or SPDI, subject to Chaitown’s compliance with the applicable laws with respect to confidentiality and privacy of User’s data. If Chaitown becomes aware that certain Personal Information and / or SPDI have been disclosed in a manner not in accordance with this Privacy Policy, Chaitown will use reasonable efforts to notify the concerned User of the nature and extent of such disclosure (to the extent Chaitown is aware of that information) as soon as reasonably possible and as permitted by applicable law.

3.1 Electronics Communication
  1. Communications from Chaitown may transmit information that is confidential and privileged information of Chaitown.

  2. The information contained in the communications is intended solely for the use of the individual or entity to whom it is addressed and others authorized to receive it.

  3. Unless you are the intended addressee, any disclosure, copying, distribution or action taken relying on the contents is prohibited and may be unlawful.

  4. If you have received such communications in error, please advise the sender by reply e-mail and/or telephone and destroy this communication immediately.

  5. This communication may contain confidential or legally privileged information.

  6. If you have received this communication in error, or if you or your employer does not consent to email messages of this kind, please notify us immediately by responding to this email and then delete it from your system.

  7. No liability is accepted for any harm that may be caused to your systems or data by this message.

3.2 Unsolicited Emails
  1. Should you voluntarily provide your personal information to us, you may receive periodic e-mail messages from us.

  2. Such messages may include special timely announcements regarding our products and services.

3.3 Anti-Spam Policy
  1. Chaitown recognizes the receipt, transmission or distribution of spam emails (i.e. unsolicited bulk emails) as a major concern and has taken reasonable measures to minimize the transmission and effect of spam emails in our computing environment.

  2. All emails received by Chaitown are subject to spam check.

  3. Any email identified as spam will be rejected with sufficient information to the sender for taking necessary action.

  4. With this measure, along with other technical spam reduction measures, Chaitown hopes to minimize the effect of spam emails.

  5. Chaitown reserves the right to reject and/or report any suspicious spam emails, to the authorities concerned, for necessary action.

4.0 Wix

  • Our store is hosted on Wix. They provide us with the online platform that allows us to sell our products and services to you.

  • Your data is stored through Wix’s data storage, databases and the general Wix application. They store your data on a secure server behind a firewall.

  • Website and Mobile App may contain or facilitate links to third party websites. Users agree and understand that privacy policies of these third-party websites are not under control of Chaitown.

  • Users understand that once a User leaves Chaitown’s servers, any information such User provides will be governed by the privacy policy of the operator of the third party website used by such User.

  • Your use of Chaitown Platform constitutes Your acceptance of the terms of the Privacy Policy as amended or revised by Us.

  • We will also keep prior versions of this Privacy Policy in an archive for your review.

  • We will redress your grievances and concerns surrounding usage of Services through Chaitown Website and mobile application and use of our website and mobile application within specified timelines as specified under the applicable law.

  • In the event of any complaint with respect to Chaitown Website, mobile application or Services, please contact the Grievance Officer, whose contact details are provided below:
